End User License Agreement for Kitcast Inc. Services

The following terms and conditions govern all use of (i) the Kitcast Inc. dashboard and product pages (the “Sites”), and (ii) the services and products available through the Kitcast applications for Apple TV and Android-based devices (the “Services” or “Applications”). Kitcast Inc. provides Applications for Apple TV and Android platforms to stream content uploaded and created via the Kitcast dashboard.

The Service is offered subject to your acceptance without modification of all the terms and conditions contained herein and all other operating rules, policies, and procedures that may be published from time to time on the Sites by Kitcast Inc.

PLEASE READ THIS END USER LICENSE AGREEMENT (EULA) CAREFULLY BEFORE ACCESSING THE SITES OR USING THE SERVICES. BY ACCESSING THE SITES OR USING ANY PART OF THE SERVICES, YOU (EITHER AN INDIVIDUAL OR A LEGAL ENTITY THAT YOU REPRESENT AS AN AUTHORIZED EMPLOYEE OR AGENT) (“YOU”) AGREE THAT YOU ARE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO ALL THE TERMS AND CONDITIONS OF THIS EULA, THEN YOU MAY NOT ACCESS THE SITES, THE SERVICES, OR ANY PART THEREOF. Kitcast Inc.’S ACCEPTANCE IS EXPRESSLY CONDITIONED UPON YOUR ASSENT TO ALL OF THE TERMS AND CONDITIONS OF THIS EULA, TO THE EXCLUSION OF ALL OTHER TERMS.

USING OUR SERVICES AND OUR WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ, UNDERSTOOD, AND ACCEPTED OUR PRIVACY POLICY, WHICH COMPLIES WITH THE PRIVACY ACT AND GENERAL DATA PROTECTION REGULATION (GDPR) 2016/679.

The Services are available only to individuals who are at least 13 years of age. If you do not meet this requirement, do not attempt to use the Services. Kitcast Inc. may refuse to offer the Services to any person or entity at any time and may change its eligibility criteria at its sole discretion. If you are between 13 and 18 years old, you may only use the Services under the supervision of a parent or guardian. It is the responsibility of parents or guardians to monitor their children’s use of the Sites and Applications.

DEFINITIONS

When used in this EULA, the following terms shall have the respective meanings indicated, applicable to both the singular and plural forms:

  • “Services” or “Applications” refer to the software applications developed by Kitcast Inc. for Apple TV and Android-based devices that provide a solution for streaming content, managed by a User.
  • “Site” or “Dashboard” or “Product page” refer to the web interface of Kitcast that provides Users with information about the Services and the tools to upload, manage, and schedule content.
  • “Add-ons” or “Extensions” refer to optional feature sets or additional capabilities of the Sites and Applications available via subscription or in-app purchases.
  • “License” means your right to use part or all of the features provided by the Sites and Applications according to your subscription or purchases.
  • “Use” or “Using” refers to accessing, installing, downloading, copying, or otherwise benefiting from the functionality of the Sites and Applications.

MODIFICATION

Kitcast Inc. may modify or discontinue the Services or this Agreement at any time without prior notice. Any changes will be communicated via the Sites or by email. Continued use of the Services after changes implies acceptance of the updated terms. If you disagree, your sole remedy is to discontinue use of the Services.

PERMITTED USES AND RESTRICTIONS

Kitcast Inc. grants You a non-exclusive, non-transferable License to use the Sites and Services. All other rights are reserved. Users may not:

  • Use the Service on more than one Apple TV or Android device simultaneously without purchasing additional licenses.
  • Connect a single Kitcast device to more than three screens or output devices per license.
  • Remove or obscure any Kitcast Inc. trademarks.
  • Sell, resell, share, transfer, or distribute licenses to third parties without prior consent.
  • Use the Applications in violation of any applicable laws or regulations.
  • Copy, reverse-engineer, or clone the Services or any of their features.

PAYMENT TERMS

Kitcast Inc. may bill via credit card or platform-specific systems (e.g., iTunes or Google Play accounts). Automatic renewals, subscription rules, and refund policies apply equally across Apple TV and Android versions of the Services. Payment terms, including upgrade/downgrade, are detailed in your billing cycle and in-app options. All prices are in U.S. Dollars.

TERMINATION

If you breach any of the terms of this Agreement, Kitcast Inc. reserves the right to suspend or disable your Account or terminate this Agreement at its sole discretion and without prior notice. Kitcast Inc. may revoke your access to and use of the Services at any time, with or without cause.

You may cancel your subscription by sending a written request to support@kitcast.tv. Cancellations will take effect within a reasonable period following confirmation of your request by our support team. You remain responsible for any charges incurred prior to the effective date of cancellation. No refunds will be issued for partial or unused subscription periods, as specified in the Payment Terms section.

Upon termination of this Agreement or cancellation of your subscription, your access to the Dashboard and content management tools will be disabled, and your content will no longer be streamed to connected devices. However, the Applications installed on your Apple TV or Android-based devices will remain on the devices unless removed by you manually.

DISCLAIMERS

The Kitcast Applications and Services are provided “as is” without warranties. Kitcast Inc. disclaims all implied warranties, including merchantability and fitness for a particular purpose. Kitcast Inc. does not guarantee uninterrupted or error-free operation across platforms.

LIMITATION OF LIABILITY

Kitcast Inc. shall not be liable for any indirect, incidental, special, or consequential damages. Your use of the Kitcast Applications (on Apple TV and Android) is at your own risk.

COLLECTION AND USE OF INFORMATION

Kitcast Inc. collects usage data across all platforms to improve functionality. Your information will be handled as outlined in our Privacy Policy. Use of the Sites and Applications constitutes consent to these practices. Kitcast may use anonymized data and your brand assets (e.g., logos) for marketing purposes.

INDEMNITY

You agree to indemnify Kitcast Inc. against any claims or liabilities resulting from your misuse of the Services, violations of this Agreement, or breaches of applicable laws.

PROPRIETARY RIGHTS NOTICES

All Kitcast Inc. trademarks are the exclusive property of Kitcast Inc. Third-party marks remain the property of their respective owners.

ENTIRE AGREEMENT

This Agreement supersedes all prior agreements between you and Kitcast Inc. regarding the Kitcast Services.

ASSIGNMENT

You may not assign this Agreement without Kitcast Inc.’s prior written consent. Kitcast Inc. may assign it freely.

NOTICES

Kitcast Inc. may notify you via email or by posting to the Site. Electronic notices are considered received on the date sent.
